OSHI MESSENGER - PROPRIETARY LICENSE AGREEMENT =============================================== Copyright (c) 2024-2026 Hugo Moriceau / Moriceau Lab All Rights Reserved. IMPORTANT: READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE. By downloading, installing, or using OSHI Messenger ("Software"), you agree to be bound by the terms of this License Agreement ("Agreement"). If you do not agree, do not use the Software. 1. DEFINITIONS -------------- "Software" means the OSHI Messenger application, including all source code, object code, documentation, graphics, user interfaces, and related materials. "Licensor" means Hugo Moriceau / Moriceau Lab. "You" or "User" means the individual or entity using the Software. 2. LICENSE GRANT ---------------- Subject to the terms of this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to: • Download and install the Software on your personal devices • Use the Software for personal, non-commercial communication purposes This license is granted solely for your personal use and does not include any rights to sublicense, distribute, or commercially exploit the Software. 3. RESTRICTIONS --------------- You may NOT, without prior written consent from the Licensor: • Copy, reproduce, or duplicate the Software or any portion thereof • Modify, adapt, translate, or create derivative works of the Software • Distribute, sell, rent, lease, sublicense, or transfer the Software • Reverse engineer, decompile, disassemble, or attempt to derive source code • Remove, alter, or obscure any copyright, trademark, or proprietary notices • Use the Software for any commercial purpose • Use the Software to develop competing products or services • Share, publish, or disclose any portion of the source code • Use automated tools to scrape, analyze, or extract data from the Software 4. INTELLECTUAL PROPERTY ------------------------ The Software and all copies thereof are proprietary to Licensor and title thereto remains exclusively with Licensor. All rights in the Software not specifically granted in this Agreement are reserved to Licensor. The Software is protected by copyright laws, international treaty provisions, and other intellectual property laws and treaties. OSHI™ and the OSHI logo are trademarks of Hugo Moriceau / Moriceau Lab. 5. SECURITY RESEARCHERS ----------------------- Security researchers are granted limited permission to: • Analyze the cryptographic implementations for security research • Test for vulnerabilities in isolated, non-production environments • Report findings through responsible disclosure to: support@oshi-messenger.org Security researchers must NOT: • Publicly disclose vulnerabilities before coordination with Licensor • Use discovered vulnerabilities for malicious purposes • Access other users' data or communications 6. NO WARRANTY -------------- THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT: • The Software will meet your requirements • The Software will be uninterrupted, timely, secure, or error-free • The results obtained from the Software will be accurate or reliable • Any errors in the Software will be corrected 7. LIMITATION OF LIABILITY -------------------------- TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL. LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED CHF 10 (TEN SWISS FRANCS). 8. INDEMNIFICATION ------------------ You agree to indemnify, defend, and hold harmless Licensor from any claims, damages, losses, liabilities, and expenses arising from your use of the Software or violation of this Agreement. 9. TERMINATION -------------- This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this Agreement. Upon termination: • You must cease all use of the Software • You must destroy all copies of the Software in your possession • All licenses granted to you will immediately cease 10. GOVERNING LAW ----------------- This Agreement shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland. 11. SEVERABILITY ---------------- If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. 12. ENTIRE AGREEMENT -------------------- This Agreement constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior agreements and understandings. 13.
